Services Agreement
Version 1.2-May-2026 ยท Governed by the laws of New Zealand
Key Principles โ read these first
- Ownership & Access: The Cooperative owns the Find My Ride platform. It operates a notice board connecting you with Riders. The Cooperative's role is limited to referral โ it does not participate in, facilitate the payment for, or take any share of your ride fares.
- Direct Contracting: When you carry a Rider, you are contracting directly with them. The Cooperative is not a party to that contract, does not collect or process fares, and is not responsible for the Rider's acts or omissions.
- Independent Status: You are a self-employed provider and a member of a mutual-benefit cooperative โ not an employee, worker, or legal partner of the Cooperative. You run your own independent transport business.
- Rights & Flexibility: You choose if, when, and where you use the App. You are never obligated to accept any request and may reject or cancel at your discretion.
- Your business, your money: You set your own fares, collect payments directly from Riders using your chosen payment method, issue your own receipts, and manage your own GST and tax obligations. FindMyRide never handles your money.
โ Please read the full agreement below before agreeing
Section 1
Entering into the Agreement
By paying the joining fee and clicking "I Agree," you enter into a binding agreement with the Cooperative. You acknowledge you have had the opportunity to seek independent legal advice before agreeing.
Section 2
Term
This Agreement starts on the date your membership is activated and continues until terminated by either party or until your membership in the Cooperative ceases.
Section 3
Membership Fees and Levies
In consideration for access to the App and facilitation services, you agree to the following fee structure:
| Fee type | Amount | When payable |
| Joining Fee | $100 | One-time, non-refundable, paid before activation |
| Annual Membership | $50 | Annually, to maintain membership status |
| Activity Levy | $10 | Per 7-day period in which you provide more than 3 rides |
Section 4
Relationship of the Parties
The parties acknowledge they do not intend to create an employment relationship. FindMyRide operates solely as a referral service โ a digital notice board. FindMyRide does not direct or control your performance, your choice of route, the price you charge, or the maintenance of your vehicle. There is no exclusivity โ you may use other rideshare applications or engage in other business at any time.
FindMyRide does not participate in the transportation service contract between you and each Rider. FindMyRide does not collect, hold, process or have any interest in your ride fares at any time. Each ride is a direct commercial transaction between you and the Rider, conducted through your own infrastructure.
Section 5
Driver Obligations
- Safety: You must provide services safely, professionally, and in compliance with all New Zealand safety and transportation legislation.
- Licensing: You must hold a valid New Zealand driver's licence with a current P Endorsement and ensure your vehicle has a current Certificate of Fitness (CoF) and Transport Service Licence (TSL).
- Work Time: You must manage your own fatigue and comply with legal work-time limits and logbook requirements.
- Incidents: You must promptly notify the Cooperative of any accidents or notifiable incidents occurring during a trip.
Section 6
Fares, Payments and GST Obligations
-
Fares set and collected by you directly:
You set your own fare for each ride by submitting an encrypted bid through the platform. If the Rider accepts your bid, the fare is a contract directly between you and the Rider. You collect payment from the Rider directly using your own chosen payment method โ this may include card payment via a payment processor of your choice, bank transfer, cash, or any other method agreed between you and the Rider. FindMyRide does not at any point receive, hold, process, authorise, or have visibility of the fare amount or payment method. FindMyRide's role is limited to operating a notice board that connects drivers and riders.
- No payment agency: FindMyRide is not your payment agent, collection agent, or intermediary for fares. FindMyRide does not remit fares to you, does not deduct amounts from fares on your behalf, and is not responsible for payment disputes between you and a Rider.
- Cooperative fees payable directly: Membership fees and activity levies (Section 3) are payable directly to the Cooperative by you and are separate from, and not deducted from, your ride fares.
-
GST opt-out โ written agreement (s.60C(2BB) GST Act 1985):
You and FindMyRide hereby agree, and record that agreement in this document as required by s.60C(2BB)(c), that you (the underlying supplier) are solely liable for the payment of GST on all transportation services you supply through the Find My Ride platform. FindMyRide is not liable for GST on those supplies.
s.60C(2BB) This opt-out is satisfied by the actual architecture of this platform: (a) receipts issued by your server identify you as the supplier; (b) this document records your agreement to bear GST liability; and (c) FindMyRide does not authorise the charge to the Rider โ fares are set by you and accepted directly by the Rider โ FindMyRide does not make or authorise delivery of the ride, and FindMyRide does not set any term or condition of your individual supplies. The encrypted bid system technically enforces these conditions: FindMyRide's servers cannot read the fare amount.
- GST threshold โ total turnover applies: You must register for GST with Inland Revenue if your total annual taxable supplies from all business activities combined โ not just rideshare โ exceed or are expected to exceed $60,000. You are solely responsible for monitoring your own turnover and registering for GST when required.
-
Receipts must identify you as supplier (s.60C(2BB)(a)):
All receipts, invoices and payment confirmations issued to Riders must identify you โ the driver โ as the supplier of the transportation service, not FindMyRide. Your driver subdomain server issues all receipts in your name.
- Platform rules are not supply terms (s.60C(2BB)(c)(iii)): FindMyRide's membership rules, safety guidelines and platform standards are conditions of your cooperative membership only. They are not terms or conditions of the individual transportation service you supply to each Rider. FindMyRide does not direct the price, route, vehicle, timing, or any other specific term of your individual trips.
Section 6A
Notification Obligations to FindMyRide (s.60H GST Act 1985)
Section 60H places active and continuing notification obligations on you as an underlying supplier. By entering this agreement you acknowledge and accept the following:
- Name and IRD number (s.60H(1)(a)): You must provide your full legal name and IRD number to FindMyRide at registration and keep this information current.
- GST registration status (s.60H(1)(b)): You must notify FindMyRide of your current GST registration status at registration.
- Changes to GST status (s.60H(2)): If your GST registration status changes at any time you must notify FindMyRide as soon as practicable. Failure to do so may result in incorrect GST treatment and additional tax liability for you.
- Election to be liable for GST (s.60H(3)): This agreement records your election under s.60C(2BB) to remain liable for GST on your supplies. FindMyRide may rely on this notification and any deficiency arising from inaccurate information you provide is your liability, not FindMyRide's (s.60H(4)).
-
Platform economy reporting (s.60H(5), Tax Administration Act 1994 Part 11B):
FindMyRide is a reporting platform operator under Part 11B of the Tax Administration Act 1994. You must comply with obligations under ss.185S(3) and 185T(2) of that Act, providing FindMyRide with your name, IRD number, bank account details, number of rides completed, and amounts earned so that FindMyRide can meet its annual reporting obligations to Inland Revenue. You authorise this collection and reporting regardless of your GST registration status.
Important The platform economy reporting framework (DAC7 / Part 11B TAA 1994) requires FindMyRide to file an annual report with Inland Revenue covering all drivers. This is a legal obligation and cannot be waived.
Section 7
Intellectual Property, Data and Privacy
Section 8
Liability and Insurance
- Indemnity: You indemnify the Cooperative against liabilities arising from your breach of law, tax obligations, or third-party claims related to your driving.
- Insurance: You must maintain motor vehicle insurance that specifically covers "hire or reward" (commercial) use as required by law. Standard personal car insurance is not sufficient.
Section 9
Termination
- By Driver: You may stop using the App or terminate this agreement at any time without notice.
- By Cooperative: The Cooperative may terminate with 30 days' notice for legitimate business reasons, or immediately if you commit a material breach or create a safety risk.
Section 10
Dispute Resolution
Any disputes will be resolved through the Cooperative's internal disputes process or via New Zealand tribunals and courts. This agreement is governed by the laws of New Zealand.
